California Last Will and Testament Forms

The Last Will and Testament forms offered below, except the statutory will, are in a format used by many California attorneys and generally follow the guidelines given by CEB (California Education of the Bar) publications.  All wills contain a self-proving attestation clause.  The appearance is a formal style with an Old English heading and side margin lines.

Will includes former names, children and parents are named, grandchildren are named. Estate is given equally to two children or to surviving child. If children predecease mom, then to grandchildren. No contest and short Executor rights clauses. Guardian designation included for teenage son. Cremation and scattering of ashes requested.

Husband and Wife Simple Reciprical Wills
This document contains two nearly identical wills. Husband and wife leave everything to each other. If both die, then to their adult children - personal and household items are divided as the children desire, a leasehold interest is given in equal shares. If a child predeceases the surviving parent, that child's interest is given to that child's children.

Two nearly identical wills. Husband and wife leave everything to each other. If both die, specific gifts of collections and special personal items are given to named individuals. The remainder of estate assets are given to the children in equal shares as the children desire. One child is a minor, an older teenager, a guardian for minor's person and estate is named but no trust is established for minor's benefit as the value of the estate is relatively small. Reference is made to burial plots and funeral instructions with a local cemetery. If a child predeceases the surviving parent, that child's interest is held in trust for that child's children with the executor acting as trustor.

Drafted for a married woman with two children, one from present marriage and the other from a former relationship. Estate is given to husband if he survives wife and he is named as guardian of choice of older child. If husband does not survive wife, estate goes to children in trust. Trustor and alternate is named and powers included. Includes no contest clause, executor and alternate without bond clause, and clause to authorize executor to continue the operation of business interests.

QTIP Will
Complex will with marital deduction trust and bypass trust. Extensive trustee and executor powers sections. Prepared for a husband with extensive separate property interests held with family members. These were placed in the bypass trust to preserve the family ranch and business. Community property assets were placed in the marital trust. Tax consequences were considered and addressed but were of secondary importance in drafting this will.
